UAE labour law — what changed, what still holds

Private sector. Last check 9 September 2026. This is a guide, not a court opinion. Confirm on MOHRE or u.ae.

  • MOHRE runs mainland and most free zones. DIFC and ADGM are different.
  • Domestic workers have their own law. Government staff are not on this page.
  • A delayed salary is a MOHRE file, not a WhatsApp agent.

    19 domestic-worker jobs listed on u.ae

    • Housemaid, cook, nanny, home nurse, family driver, gardener, private tutor, personal trainer and others — 19 titles.
    • Separate law: Federal Decree-Law 9 of 2022, not the private-sector labour law.
    • Hire only through a MOHRE-licensed agency.
    • Paid weekly rest, 12 hours rest a day (8 consecutive), 30 days annual leave.

    11 labour violations you can report to MOHRE

    • Unpaid end-of-service, more than two overtime hours, no annual leave, heat-stress rules, bad labour housing.
    • Also: fake Emiratisation, forced labour, sexual harassment, illegal worker, safety breaches.
    • MOHRE app, mohre.gov.ae, 600 590 000, or labour claims 80084.
    • A WhatsApp ‘labour lawyer’ is not MOHRE.

    WPS: salary due on the 1st of the next month

    • Ministerial Resolution 340 of 2026. In force 1 June 2026.
    • Old rule: often until the 15th of the next month. New rule: 1st of the next month.
    • Company is ‘compliant’ if it pays at least 85% of wages due by that date — you are still owed 100%.
    • Private sector on MOHRE / WPS. DIFC and ADGM have their own rules.

    Labour housing: Resolution 122 of 2026

    • Applies if the company has 50+ workers and the wage is AED 1,500 or less.
    • Housing must be MOHRE-approved and registered.
    • New minimums include access for People of Determination and rights information in more than one language.

    Emirati private-sector minimum wage AED 6,000

    • From 1 January 2026, MOHRE set AED 6,000 a month for UAE nationals in the private sector.
    • This is not a minimum wage for every expat job. Expat wages are in the contract and WPS.
    • Emiratisation quotas still rise for firms with 50+ skilled staff.

Still the law

Which law

  • Private sector (mainland and most free zones): Federal Decree-Law 33 of 2021, amended 2023.
  • Does not cover: government staff, police/military, domestic workers (separate law).
  • DIFC and ADGM: their own employment laws, not MOHRE.

Hours and overtime

  • Normal: 8 hours a day or 48 hours a week.
  • Break of at least one hour; no more than five hours straight without a break.
  • Overtime: usually up to 2 extra hours a day. More than that is a reportable violation.

Leave and maternity

  • Annual leave: 30 days after one year (pro-rata in year one — check the contract and u.ae).
  • Maternity (private sector): 60 days — 45 at full pay, 15 at half pay. From day one of the job.
  • You cannot be fired because of pregnancy or maternity leave.

End of service (gratuity)

  • Calculated on basic salary, not the full package, unless the contract says more.
  • 21 days’ basic per year for the first five years; 30 days’ basic after that (capped — confirm on u.ae).
  • Unpaid gratuity is one of the 11 things you can report.
